What happens at a North Carolina foreclosure sale

  1. 1. The auction

The trustee sells your home to the highest bidder at a public auction, usually at the county courthouse.

  2. 2. The 10 day upset bid period

After the sale is reported to the Clerk of Superior Court, anyone can raise the bid within 10 days. Each new bid starts another 10 day period.

  3. 3. The sale becomes final

When a 10 day period passes with no new bid, the sale is locked in and the buyer takes title to your home.

  4. 4. The Sheriff can remove occupants

The buyer can get an order for possession from the Clerk. After the required notice, the Sheriff can remove everyone living there and their belongings.

Do not wait until the last minute. The closer you get to your sale date, the fewer options you have. Once the upset bid period ends with no new bid, the sale is final.
